Welcome to MindsetForge. These Terms of Service ("Terms") govern your access to and use of the MindsetForge mobile application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using MindsetForge you represent and warrant that you meet this requirement and that the information you provide is accurate.
MindsetForge is a personal-development application that provides AI-assisted mindset coaching, journaling, goal and habit tracking, affirmations, and related self-improvement tools. Coaching responses are generated with the assistance of artificial intelligence and are provided for informational and motivational purposes only.
MindsetForge is a mindset and personal-growth coach. It is not therapy, counseling, or medical care, and it is not a substitute for advice, diagnosis, or treatment from a licensed mental-health professional, physician, or other qualified provider. Do not disregard or delay seeking professional help because of anything you read in the Service. If you are experiencing a crisis or thinking about harming yourself or others, contact emergency services (911 in the US) or the 988 Suicide and Crisis Lifeline (call or text 988) immediately. The Service does not provide emergency or crisis services.
Some features require a paid subscription. Subscriptions are processed through the applicable app store and managed via our payments provider (RevenueCat). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours prior to the end of the period. You can manage or cancel your subscription in your app store account settings. Except where required by law, payments are non-refundable.
You agree not to misuse the Service, including by attempting to access it through unauthorized means, reverse engineering it, using it to violate any law, harass others, or submit content that is unlawful or infringing. You are responsible for keeping your account credentials secure and for all activity under your account.
You retain ownership of the content you create in the Service, such as journal entries, goals, and messages. You grant MindsetForge a limited license to store and process this content solely to operate and improve the Service for you, including sending relevant context to our AI provider to generate personalized responses.
The Service, including its software, design, and content (excluding your content), is owned by MindsetForge and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your situation.
To the maximum extent permitted by law, MindsetForge and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
You may stop using the Service and delete your account at any time from the in-app settings. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections intended to survive termination will continue to apply.
We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, United States, with venue in Riverside County, California, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located there for any dispute that is not subject to arbitration or small-claims resolution.
